Who Regulates Agricultural Buildings in the Lower Mainland and Fraser Valley?
Agricultural buildings in the Lower Mainland and Fraser Valley fall under the jurisdiction of two overlapping authorities:
- Local municipalities — issue building permits and apply the BC Building Code
- Agricultural Land Commission (ALC) — governs land use on Agricultural Land Reserve (ALR) property
Most agricultural land in the Fraser Valley is within the ALR. This means you need to satisfy both municipal building code requirements and ALC land use rules before you can break ground.
When Do You Need a Permit?
Under the BC Building Code, most structures over 10 square metres (107 sq ft) require a building permit — including agricultural buildings. However, BC Building Code Section 3.1.1.1 provides some exemptions for farm buildings, and there are specific provisions for farm structures used exclusively for farming purposes.
The "farm use" exemption sounds broader than it is. Structures used for residential, commercial, or non-farm purposes — even on ALR land — are not exempt and require full building permits. When in doubt, apply for the permit.
The ALC and Non-Farm Use
If you want to build something on ALR land that isn't for farm use — a worker's cottage, a commercial facility, a rental — you need ALC approval for non-farm use, which is a separate application process from the building permit. For a straightforward farm building on ALR land in the Fraser Valley (Abbotsford, Chilliwack, Mission), the permit package typically includes:
- Completed building permit application
- Site plan showing setbacks from property lines, roads, and watercourses
- Floor plans and elevations
- Structural drawings (engineer-stamped for larger buildings)
- Confirmation of farm status (BC Farm ID or property tax farm class)
- Drainage and site servicing plan
Setback Requirements for Agricultural Buildings
Setback requirements vary by municipality and zone, but typical minimums include:
- 30m from a public road right-of-way
- 7.5m–15m from a side or rear property line
- 30m from a watercourse (may be greater in riparian areas)
- Minimum separation from neighbouring residential dwellings (for livestock facilities)
Engineering Requirements
BC's Fraser Valley experiences significant snow loads — particularly east of Abbotsford. Agricultural buildings must be engineered to the correct snow and wind loads for their specific location.
